1. Acceptance of terms
By downloading, accessing, or using DailyReportr+ (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. The Service
DailyReportr+ provides construction project and field-reporting tools, including daily reports, project records, labor and resource tracking, photos and attachments, offline-capable workflows, synchronization, signatures, and report exports. Features may differ by device, platform, account, or subscription.
3. Accounts
You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account and for ensuring that authorized project participants use the Service appropriately.
4. Your records and responsibilities
You retain ownership of content and project records you submit. You are responsible for the accuracy, legality, permissions, and appropriate use of that content. You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes.
- Upload content you do not have the right to use or disclose.
- Attempt to bypass access controls or compromise the Service.
- Interfere with other users, networks, or service operation.
- Reverse engineer the Service except where applicable law expressly permits it.
5. Field records and professional judgment
DailyReportr+ is a documentation tool. It does not replace contractual notice requirements, safety programs, professional judgment, legal advice, or review by qualified project personnel. You are responsible for reviewing reports before issuing or relying on them.
6. Offline use and synchronization
The Service may store information locally and synchronize after connectivity returns. Network interruptions, device storage limits, conflicting edits, permissions, or service outages can delay or prevent synchronization. Maintain appropriate copies of critical project records and verify that important reports have been successfully issued.
7. Subscriptions and payment
Certain features may require a paid subscription. Prices, billing periods, trials, renewals, and cancellation terms are shown before purchase by the applicable platform marketplace. Marketplace billing and refund rules apply. Unless required by law, fees are non-refundable.
8. Privacy
Our Privacy Policy explains how information is processed in connection with the Service and is incorporated into these Terms by reference.
9. Intellectual property
The Service, including its software, interface, branding, and original content, is owned by Lab Architect or its licensors and is protected by applicable intellectual-property laws. These Terms grant only a limited, revocable, non-transferable right to use the Service as intended.
10. Availability and changes
We may modify, suspend, or discontinue features; apply reasonable limits; or release updates needed for security, compatibility, or operation. We do not guarantee that every feature will remain available on every platform.
11. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR A PARTICULAR CONTRACTUAL, SAFETY, OR LEGAL PURPOSE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAB ARCHITECT AND DAILYREPORTR+ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS OR REVENUE; OR LOSS OF DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM THE SERVICE.
13. Indemnification
To the extent permitted by law, you agree to defend and hold harmless Lab Architect, DailyReportr+, and their personnel from claims, liabilities, losses, and expenses arising from your unlawful use of the Service, your content, or your violation of these Terms.
14. Suspension and termination
We may suspend or terminate access when reasonably necessary to protect the Service, comply with law, address nonpayment, or respond to a material breach. You may stop using the Service at any time. Provisions that by their nature should survive termination will remain effective.
15. Changes to these Terms
We may update these Terms as the Service or applicable law changes. Revised Terms will be posted with a new effective date. Continued use after revised Terms become effective constitutes acceptance where permitted by law.
16. Governing law
These Terms are governed by applicable law, without regard to conflict-of-law principles. Any mandatory consumer protections available in your jurisdiction remain unaffected.
